Whittington's parents file wrongful death suit against Connor Wood

The parents of 16-year-old Matthew Whittington have filed a wrongful death suit against the family and estate of the teenager accused of killing their son.

Dennis and Judy Whittington of Ferriday filed the suit on February 18th in Seventh Judicial District Court in Vidalia. Their attorney is Philip LeTard Sr. of Vidalia.

Charged in the March 14, 2007, death of Whittington is 16-year-old Connor Wood, who was 15-years-old on the night Whittington and Wood's parents -- 42-year-old John David Wood and 40-year-old Geraldine Trevillion Wood -- were killed. All three were shot to death in the Wood's home on 119 Shady Lane in the Woodland Subdivision of Ferriday.

Connor Wood's trial in the murders is scheduled for April 14th.

Named as defendants in the wrongful death suit are the estate of John and Geraldine Wood; son John Hudson Wood, who is also the administrator of the estate; Connor Wood through his tutor, Fred E. Scott of St. Joseph; and XYZ Insurance Company, the Wood's homeowner's insurer.

The suit says that John Hudson Wood, as the estate administrator, "accepted successions unconditionally and placed himself in possession of the entire estate of John D. Wood and Geraldine Wood."

Dennis and Judy Whittington claimed in their suit that Connor Wood "intentionally and without justification" killed his parents "as they slept" and "an innocent friend, Matthew Whittington." The suit alleges that the Woods owned firearms and ammunition "freely accessible and available" to Connor Wood and that Wood's parents did not "properly supervise" their son.

The Wood's should have known or knew, the suit claims, that Connor Wood had "antisocial tendency and was capable of murder." Additionally, the couple should have known their son's "unbalanced, anti-social tendency" and the "readily available firearms and ammunition" was "detrimental to the safety and well being of the family and friends of the family."

The Whittington's are seeking "wrongful death damages" for loss of love, affection and companionship in the death of their son, for the loss of "daily service, attention and emotional support" from Matthew Whittington and for "mental pain, suffering and distress caused by the loss..."

During the murder, says the suit, "Matthew Whittington must have suffered due to the nature of the death," and "therefore defendants should be required to pay for the severe emotional and mental anguished experienced" prior to his death.

The Whittingtons are requesting a trial by jury.
