SIXTH JUDICIAL DISTRICT COURT
PARISH OF TENSAS

THE GRAND JURORS of the State of Louisiana, good and lawful men of the Parish of Tensas duly empaneled, sworn and charged to enquire for the body of said Parish, acting in the name and by the authority of the State of Louisiana, on their oath do present:

THAT BOBBY D. HIGGINBOTHAM

late of the Parish aforesaid, in the Sixth Judicial District of the State, in the Parish, District and State aforesaid,

COUNT ONE;

did commit Malfeasance in Office by violating R. S. 42:1112, by purchasing goods and services and instructing Town of Waterproof employees to purchase goods and services from a business or entity in which he/and or immediate family members has a personal substantial economic interest, in the approximate amount of $56,582.57, all in violation of R.S. 14:134.

COUNT TWO:

did commit Malfeasance in Office by intentionally and without authorization using Town of Waterproof funds for personal travel unrelated to Waterproof town business purposes to such cities as Los Angeles, California, Las Vegas, Nevada, Chicago, Illinois, San Francisco, California, in the approximate amount of $3,280.96 all in violation of R.S. 14:134.

COUNT THREE;

did commit Felony Theft by taking and/or using approximately $3,280.96 from the Town of Waterproof for personal travel by fraudulent means, all in violation of R.S. 14:67.

COUNT FOUR:

did commit Malfeasance in Office by intentionally using Town of Waterproof funds for personal travel unrelated to Waterproof town business purposes during the month of February, 2008 by obtaining money for advance travel expenses, all in violation of R.S. 14:134.

COUNT FIVE

In October, 2007, did commit Malfeasance in Office by intentionally and improperly converting and depositing $32,027.00 from Meter Deposit Fund belonging to the citizens of Waterproof and used for unauthorized purposes, all in violation of R.S. 14:134.

COUNT SIX:

From January 2007 through April, 2008, did commit Malfeasance in Office by violating R.S. 32:98.2.b by disposing of citations outside of court and allowing Chief Miles Jenkins to dispose of citations in violation of R.S. 33:441.b, all in violation of R.S. 14:134.

COUNT SEVEN:

From January 2007 through April, 2008 did commit Malfeasance in Office by failing to keep a regular docket of all cases administered in Mayors Court, all in violation of R.S. 33:442.

COUNT EIGHT:

From January 2007 through April, 2008, did commit Malfeasance in Office by failing to report traffic violations for the Town of Waterproof to the Louisiana Department of Public Safety all as required by R.S. 32:393.c(l)(b), all in violation ofR.S. 14:134.

COUNT NINE:

From January 2007 through April, 2008, did commit Malfeasance in Office by paying Waterproof Chief of Police, Miles Jenkins. illegal and unauthorized bonuses, in addition to salary fixed by the Board of Alderman all as required by R.S. 33:404.1.

COUNT TEN:

From January 2007 through Apri 1,2008 did commit Malfeasance in Office by violating Art. VII Section 14 (A) of the Louisiana Constitution of 1974 by improperly paying bonuses to Town of Waterproof Police Officer, Everett Richardson, for exceeding illegal ticket quotas.

COUNT ELEVEN:

From January 2007 through April, 2008 did commit Malfeasance in Office by violating Art. VII Section 14 (A) of the Louisiana Constitution of 1974 by improperly paying bonuses to Town of Waterproof Police Officer, Craig Carter, for exceeding illegal ticket quotas.

COUNT TWELVE:

From January 2007 through April, 2008 did commit Malfeasance in Office by violating Art. VII Section 14 (A) of the Louisiana Constitution of 1974 by improperly paying bonuses to Town of Waterproof Police Officer, Wayne Robinson, for exceeding illegal ticket quotas.

COUNT THIRTEEN:

From January 2007 through April, 2008 did commit Malfeasance in Office by violating Art. VII Section 14 (A) of the Louisiana Constitution of 1974 by improperly paying bonuses to Town of Waterproof Police Officer, Elliolt Green, for exceeding illegal ticket quotas.

COUNT FOURTEEN:

From January 2007 through April, 2008 did commit Malfeasance in Office by violating Art. VII Section 14 (A) of the Louisiana Constitution of 1974 by improperly paying bonuses to Town of Waterproof Police Officer, Chief Miles Jenkins, for exceeding illegal ticket quotas.

COUNT FIFTEEN;

From January 2007 through April, 2008 did commit Malfeasance in Office by violating Art. VII Section 14 (A) of the Louisiana Constitution of 1974 by improperly paying bonuses to Town of Waterproof Police Officer, Terrance Boatner, for exceeding illegal ticket quotas.

COUNT SIXTEEN:

From January 2007 through April, 2008 did commit Mal feasance in Office by violating Art. VII Section 14 (A) of the Louisiana Constitution of 1974 by improperly paying bonuses to Town of Waterproof Police Officer, Stephanie Walker, for exceeding illegal ticket quotas.

COUNT SEVENTEEN:

From January 2007 through April, 2008, did commit Malfeasance in Office by commingling his personal business with the business of the Town of Waterproof by using the Town of Waterproofs payroll system to collect monies from personal loans alleged to have been, made to town employees, all in violation of R.S. 14:134.

COUNT EIGHTEEN:

From January 2007 through April, 2008, did commit Public Salary Deduction by diverting for his own use or the use of other persons part of the salary allowed by law to public employees without prior written authorization from said public employee, Marshall dark, all in violation of R.S. 14:135.

COUNT NINETEEN:

From January 2007 through April, 2008. did commit Public Salary Deduction by diverting for his own use or the use of other persons part of the salary allowed by law to public employees without prior written authorization from said public employee, Michael Barece, all in violation of R.S. 14:135.

COUNT TWENTY:

From January 2007 through April, 2008, did commit Public Salary Deduction by diverting for his own use or the use of other persons part of the salary allowed by law to public employees without prior written authorization from said public employee. Chuck Barece, all in violation of R.S. 14:135.

COUNT TWENTY-ONE:

From January 2007 through April, 2008, did commit Public Salary Deduction by diverting for his own use or the use of other persons part of the salary allowed by law to public employees without prior written authorization from said public employee, David James, all in violation of R.S. 14:135.

COUNT TWENTY-TWO;

From January 2007 through April, 2008. did commit Malfeasance in Office by ordering town employees, on more than one occasion, to take a backhoe and oilier equipment having a value in excess of $1,000.00 to clean, mow and or improve private property, with the defendant and/or the Town of Waterproof receiving the payment proceeds for the work, all in violation of R.S. 14:134.

COUNT TWENTY-THREE:

From January 2007 through April, 2008, did commit Unauthorized Use of a Movable by ordering town employee, Marshall dark, to take a backhoe having a value in excess $1,000.00 without authorization beyond the city limits of the Town of Waterproof, all in violation of R.S. 14:68.

COUNT TWENTY-FOUR:

From July 2007 through February 2009, did commit Malfeasance in Office by increasing his salary in the total amount of $36,500.00, without the approval and/or knowledge of the Board of Alderman contrary to the requirements in R.S. 33:404.1, all in violation of R.S. 14:134.

COUNT TWENTY-FIVE:

In July 2007, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary in the total amount of $1,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT TWENTY-SIX:

In August 2007, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $1,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT TWENTY-SEVEN:

In September 2007, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT TWENTY-EIGHT;

In October 2007, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT TWENTY-NINE:

In November 2007, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation ofR.S. 14:67.

COUNT THIRTY:

In December 2007, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT THIRTY-ONE:

In January 2008, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT THIRTY-TWO:

In February 2008, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT THIRTY-THREE;

In March 2008, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT THIRTY-FOUR:

In April 2008, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT THIRTY-FIVE:

In May 2008. did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT THIRTY-SIX;

hi June 2008, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT THIRTY-SEVEN:

In July 2008, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT THIRTY-EIGHT:

In August 2008, did commit Felony Theft by (lie lak ing of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, ati in violation of R.S. 14:67.

COUNT THIRTY-NINE:

In September 2008, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT FORTY;

In October 2008, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT FORTY-ONE:

In November 2008, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT FORTY.TWO:

In December 2008, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

COUNT FORTY-THREE:

In January 2009, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in the total amount of $2,000.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.


COUNT FORTY-FOUR:

In February 2009, did commit Felony Theft by the taking of extra compensation by fraudulently increasing his salary, in (he total amount of $500.00, without Waterproof Town Alderman approval, all in violation of R.S. 14:67.

contrary to the form of the Statue of the State of Louisiana in such case made and provided, in contempt of the authority of the State of Louisiana, and against the peace and dignity of the same.
