Ferriday seeks DA opinion on employee back pay

The Ferriday Town Council agreed Tuesday night to ask the District Attorney whether a town employee should receive back pay.

The ongoing drama of whether to provide Water Superintendent Gregory Griggs with back pay began a few weeks ago. At Tuesday's meeting, alderwoman Gloria Lloyd was given authority by the coucnil to discuss the legality of the matter with the District Attorney.

Griggs was terminated by Mayor Glen McGlothin on March 16 before being rehired by the council about six weeks later.

Town Attorney Anna Ferguson said she contacted the Louisiana Legislative Auditor's Office and other attorneys and was advised that because Griggs was an hourly worker at the time his back pay could not be determined.

Griggs was changed to a salary worker when the town approved its budget last month.

"We run into the legal problem of if the board pays the person they are guilty of malfeasance and the person receiving the money is guilty of public payroll fraud," Ferguson said.
