Former Waterproof mayor's conviction, sentence reinstated

The Louisiana Second Circuit Court of Appeal in Shreveport has reinstated the felony convictions of former Waterproof Mayor Bobby Higginbotham for malfeasance and felony theft.

After a three-judge panel overturned Higginbotham's conviction on April 25, Tensas Parish District Attorney James Paxton appealed and was granted a rehearing.

On June 22, a five-judge panel set aside the court's April 25 decision and affirmed Higginbotham's conviction and sentence.

Serving on the five-judge panel were Chief Judge Harry N. Brown Jr., along with judges Felicia Williams, Gay C. Gaskins, J. Jay Caraway and Harmon Drew Jr..

Caraway and Williams dissented for reasons assigned in their initial opinion on April 25 in which Higginbotham's conviction was overturned, his sentence vacated and the case remanded to district court.

"We believe that the five-judge panel was correct in affirming the original ruling" of district Judge John Crigler, said Tensas Assistant District Attorney Linda Watson.
