A federal judge has denied motions filed by Jim Whittington alleging newly discovered evidence. Last spring, a jury ruled against Whittington in his lawsuit against former Concordia Parish Sheriff Randy Maxwell. In a new ruling issued Friday, Dec. 28, Chief Judge Dee Drell of the Alexandria Division of the Western District of Louisiana denied Whittington's motions for a new trial, an alternative motion for judgment notwithstanding the verdict and a motion for sanctions based upon perjury of a witness. The court also denied a motion filed by Maxwell for sanctions. Whittington alleged that District Attorney Brad Burget committed perjury when testifying in court last spring.
